Welcome to LevysArt’s official website. These Terms of Service ("Terms") govern your use of our site, including purchasing artwork, browsing, or interacting with any features of the website. By using this site, you agree to these Terms. If you do not agree, please do not use this website.

Use of the Website

  • You must be at least 18 years old to make a purchase.

  • You agree not to misuse this website or engage in any activity that disrupts its functionality or harms other users.

  • You are solely responsible for any content or information you submit to the website (e.g., comments, inquiries).

Purchases and Payment Terms

  • Order Process: All orders placed through the website are subject to confirmation. We reserve the right to refuse or cancel orders for any reason.

  • Payments: Payments are processed securely through LevysArt. You agree to provide accurate payment information. Payments may be processed through third-party payment providers. LevysArt does not store full credit card details and is not responsible for errors, delays, declined payments, or security practices of third-party payment providers.

  • If artwork arrives damaged, the buyer must contact LevysArt within 48 hours of delivery and provide clear photographs of the artwork, packaging, and shipping label. LevysArt will review the claim and determine the appropriate resolution, which may include repair, replacement where possible, refund, or filing a claim with the shipping carrier.

  • Artwork images on the website are provided for reference. While we make every effort to present colors, textures, and details accurately, the appearance of artwork may vary depending on screen settings, lighting, photography, and the handmade nature of the work. Minor variations are not considered defects.

Cancellation

  • Orders may be canceled by the buyer only before the artwork has been packed, shipped, or prepared for delivery. Once an artwork has been shipped, cancellation is no longer available. Custom, commissioned, or personalized orders cannot be canceled once confirmed.

Custom Artwork

  • Custom or commissioned pieces may require partial or full payment upfront. Once confirmed, these orders cannot be canceled or refunded.

  • Custom or commissioned artworks may require a deposit or full payment before work begins. Timelines are estimates and may vary depending on the nature of the work. Unless agreed in writing, commissioned artwork is created according to the artist’s style and creative judgment. Deposits and payments for custom or commissioned artwork are non-refundable once the order is confirmed.

Communication

  • Customers may communicate with LevysArt through WhatsApp, email, phone, or other direct communication channels. Any purchases arranged through these channels are also subject to these Terms unless otherwise agreed in writing. Marketing messages will only be sent where permitted by law or with the customer’s consent, and customers may request to stop receiving promotional messages at any time.

Shipping and Delivery

  • Shipping times and costs are displayed at checkout. International buyers are responsible for any applicable customs duties or taxes.

  • LevysArt is not responsible for delays caused by third-party shipping carriers.

Intellectual Property

  • All content on this site, including artwork, images, and text, is owned by LevysArt or licensed for use. You may not reproduce, distribute, or modify any material without prior written consent.

Limitation of Liability

To the fullest extent permitted by law, LevysArt is not liable for any damages arising from:

  • Use or inability to use the website.

  • Loss of data or profits resulting from technical issues or errors.

Changes to Terms

  • We may update these Terms periodically. Continued use of the site after updates constitutes acceptance of the new Terms.

Ownership of Content

  • All images, text, and artwork on this website are the exclusive property of LevysArt. Unauthorized use, reproduction, or distribution is strictly prohibited.

  • Purchase of an artwork grants the buyer ownership of the physical artwork only. Copyright, reproduction rights, image rights, licensing rights, and all intellectual property rights remain with the artist and/or LevysArt. Buyers may not reproduce, resell images, create merchandise, mint NFTs, license, publish, or commercially use images of the artwork without prior written permission.

Permissions and Licensing

  • If you wish to feature or reproduce the artist’s work, please contact us at meir.levysart@gmail.com to discuss licensing agreements. Unauthorized commercial use will result in legal action.

  • LevysArt may continue to display images of sold artworks on its website, social media, catalogs, press materials, archives, and promotional materials unless otherwise agreed in writing.
